Case#: 0208004211/ Aggravated Battery with a deadly weapon/ Date: 05/18/08

Location:  North Sierra Place & Las Lomas Drive, Santa Fe, NM (Valle Vista Subdivision)

On 5/18/08 deputies were dispatched to the above stated area in reference to a fight in progress.  Deputies arrived on scene in which a 14 year old advised that she was struck in the face by 1 of 3 male subjects walking in the area.  While conducting the investigation, SFPD located the vehicle of several subjects who were involved in the fight at the above location.  The 6 subjects were involved in an earlier altercation which occurred inside the city limits.  Another call came in to dispatch in which a victim was at St. Vincent Hospital and advised that he was involved in the same altercation at the above location.  He stated that he was hit over the head and was stabbed.  He sustained a laceration to his head and a stab wound to his lower abdomen.  It was later learned that the 6 subjects were defending themselves due to the subject at the hospital pulling out a gun.

Location:  Birch Street, Santa Fe, NM (Cottonwood Mobile Home Park)

On 5/18/08, 2 male suspects entered a vehicle through a driver's side door. The vehicle was parked on Birch Street at the Cottonwood MHP.  Once inside suspects removed a car stereo from within.  A neighbor of the victim had seen the crime in progress and gave chase to the suspects who fled the area.  Suspects dropped the stereo about 50 feet from the vehicle.  Suspects were not located.

Suspect:  Bernie Maestas, age 41, Santa Fe, NM

Charged:  Bench warrant out of Santa Fe Municipal Court for Failure to appear

On 5/17/08 while deputy was enroute to another call, suspect was located at above location almost falling onto roadway and then began walking on the roadway.  Suspect was highly intoxicated and almost fell.  Suspect was ran through NCIC and a warrant was located for failure to appear out of Santa Fe Municipal Court.  Suspect was arrested, transported and booked into the Santa Fe County Adult Detention Center.

Case#: 0208004179/ Driving on a Revoked Driver's License, Careless Driving, No Insurance/ Date: 05/17/08

Location of arrest:  State Road 599 & West Frontage Road, Santa Fe, NM

Suspect:  Isaac Trujillo, age 19, Santa Fe, NM

Charged:  Driving on a revoked driver's license, Careless Driving, No Insurance

On 5/17/08 driver was stopped for making a left hand turn over a roadway median onto State Road 599.  Driver had a revoked driver's license with the arrest clause.  Driver did not have insurance for the vehicle.  Driver was then arrested, transported and booked into the Santa Fe County Adult Detention Center.

Case#: 0208004181/ Receiving Stolen Property, DWI, Negligent Use of a Deadly Weapon/ Date: 05/17/08

Location of arrest:  Airport Road/ Country Club Road, Santa Fe, NM

Suspect:  Luis Horta, age 32, Santa Fe, NM

Charged:  Receiving Stolen Property, DWI, Negligent Use of a Deadly Weapon

On 5/17/08 a fight in progress was reported to dispatch at the Allsups on Morning Drive in which a suspect in a red Ford pickup was brandishing a handgun.  Vehicle was located and a traffic stop was conducted.  Upon making contact with the driver, he displayed signs of impairment.  He admitted that he had a handgun under the center console of the vehicle.  Suspect submitted to SFST's and displayed impairment.  Suspect was taken into custody and agreed to submit to a breath test.  His Brac was .07, .08.  The handgun was located and the serial number was ran in which it came back as stolen.  Suspect was then transported and booked into the Santa Fe County Adult Detention Center.

On 05-18-2008 at approximately 2105 hours, the above suspect was stopped for Roadways Laned for Traffic as it was observed at the above location. The suspect displayed signs of impairment. He was given a breath test with the result of .13/ .14 BrAC.

On 05-18-08 the victim reported that someone had taken his ATV on 05-16-08 between 8:00am and 11:00am. The vehicle was entered into NCIC.

On 05-16-08 the victim reported that someone broke into his residence between 6:30am and 4:15pm. It is believed that the suspect gained entry through the sliding door. The incident is currently being investigated by the Investigations Division.
