0209006843 Burglary (auto) / Criminal Damage

Deputy Assigned: Nathan Segura

Location: Cotton Wood Village MHP

Items damaged: Vehicle Tires, Car Stereos. Value over $1000.00

Sometime between 12:00am and 6:00am on 8/1/09 a group of unknown juveniles broke into and/or slashed the tires of 16 different vehicles within the Cottonwood Village Mobile Home Park. All the incidents happened in the common/parking area within the park. The tires were punctured with a sharp object, 4 cars were broken into. This incident is currently under investigation by the Sheriff’s Office.

0209006822 DWI/Neglegent use of a Firearm 07-31-09

Deputy Assigned: Brian Nissen

Location: SFCRD 62/West Frontage SFNM

Arrested: Marcellus Davis 37yoa

On the above date, the above officer conducted a welfare check on the defendant who was parked on the shoulder at the above location.  Upon attempting to awake the defendant, he was unresponsive.  After several attempts, he finally awoke.  Officer detected that the defendant was impaired.  Defednant failed field test and was arrested.  The defendant had .13 and .14 BrAC and was transported and booked at the adult detention center.

Case#: 0209006818, Driving while license suspended or revoked, Date: 07/30/09

Location of arrest:  CR 33 and US 285, Santa Fe, NM (Lamy)

Suspect:  Joshua J. Herrera, age 25, Santa Fe, NM

Charged:  Driving on a suspended/revoked driver's license

On 7/30/09 suspect was observed operating the vehicle on US285 near CR 33.  Contact was made with the suspect during which time it was found that the suspect currently possessed an operator's license which was revoked.  Suspect was arrested, transported and booked into the Santa Fe County Adult Detention Center.

Case#: 0209006820/ Larceny/ Date: 07/30/09

Location:  residence off of Aventura Road, Santa Fe, NM (Eldorado)

Victim reported that a Dell laptop computer was taken after Fedex delivered the item to the front porch at around 1300 hours.  Victim contacted Fedex and found computer was delivered however when she arrived home package was missing.  Neighbor confirmed that package was delivered.  Estimated value of items taken is $1000.00.

On the above date the victim called our agency to report that her ex-daughter in-law had stole her vehicle and was refusing to return it. According to the victim the ex-daughter in-law wants $1,000.00 then she will return the vehicle.

On the above date the victim reported that someone had stole several items from his garage sometime between 07-01-09 and today. He believes it might be his ex-wife's boyfriend.

Charges: Battery / Abandonment Or Abuse Of A Child

On the above date the suspect was involved in an altercation with the victim. Before the altercation started the suspect was holding a baby in her arms and threw the baby to the ground then started fighting with the other female. The baby was not injured and  the victim sustained minor injuries. The suspect was placed under arrest and booked accordingly.

0209006794Aggravated Assault upon a Health Care Worker

Location of incident: 123 Wild Dog Rd, Madrid, NM

Suspect: Frank Ybarra age 54

Charges: Refered to DA's office

On Thurs 7/30/09, at approx 0200hrs/am, 2 male EMT's from County Med unit 60 had responded to a medical call, at above listed address. A female caller met the EMT's at the front door, and let them in. The female and her ill friend were temporary visitors to the homeowner/suspect. The female went to the back bedroom to show the EMT's where the patient was. The EMT's however were confronted by the suspect, who was holding a large knife by the blade, over his shoulder in a "cocked" position, and ready to throw. The EMT'S retreated to their truck. The suspect who was highly intoxicated stated that 2 unknown males just suddenly appeared in his livingroom, and did in fact grab his knife in self defense. The suspect did not know that his female friend had called the Medics, or that she had let them in. Case refered to the DA's office for further review.

Victim reported that sometime between July 27, 2009 at 12:00 p.m. and July 29, 2009 at 10:00 p.m. an unknown person gained unlawful entry into his unoccupied residence through an unlocked door.  The suspect(s) stole a hand gun and three pair of earrings.  No suspect or witness information is available at this time.

On 7/29/09 above victim reported he was leaving residence and noticed an open window.  Victim checked residence and also found the window screen forced off window.  Victim did not find anything missing and believed no access was gained.
